The Legal Stuff

Please read the terms and conditions and privacy statement below about work conducted and carried out by Rebecca Wilkinson.

Terms and Conditions:

These terms and conditions outlay all services provided to a client regarding website work, content work and all social media content created.

  • Please read these terms carefully before any commitment is made working with us.
  • These terms and conditions tell the client who we are, how we will provide services to the client, and we have the right to change or end a contract if required.
  • At any time, we may change or modify these terms and conditions, and any changes or modifications will take immediate effect.
  • Continued use of any services provided by us means the client constitutes acceptance of the amended terms and conditions.
  • If anything changes dramatically within these terms and conditions, such as change of service or cancellation of a provided service, we will notify the client by email 30 days in advance of any changes to our services.
  • The obligation is then upon the client to ensure that the email they have provided to us is up to date.
  • We accept no liability or responsibility for failure to receive any email communications from us if such failure results from an inaccurate email address.
  • All agreements for work, are confirmed via email and in writing before any work is carried out. Emails are considered a legal contract of work between Rebecca Wilkinson and client.
  • Refunds are not eligible for any work carried on website designing, SEO, Audits, Content Creation or Social Media Management.
  • However, in the unlikely event that a website is not running efficiently, or to the standard in which was hoped for the site, to resolve the issue, we will endeavour to work with the client to fix the issues to ensure the client is happy with the end result.
  • Certain forms of expression, such as text, images, and music, are automatically covered by copyright under the Australian Copyright Act.
  • To achieve its objectives, the copyright system treats different uses of content in different ways, it’s for this reason all website designs will be noted as a design from us, however, no blog or social media content will be credited to the creation of us and will belong to the brand/business.
  • The costs of service are displayed on this website and are negotiable from the starting rates onwards to create bespoke packages for different client budgets.
  • We reserve the right to change those rates at any time.
  • In the event any rates are adjusted, at least one month’s notice will be provided to the client to advise of such changes.
  • We do not provide hosting services for any client websites, this means any public liability for loss of work or malware threats and attacks which is caused by a host of the clients website, is not liable to us, but the host instead.
  • However, you can contract us to work through the issues which may arise from above to assist in returning your site back to optimum health by working with your host and any other service you use.
  • Should you contract us to manage the backend of a clients website with regular monthly maintenance, part of that service will be to ensure the healthy running of the website and prevention of malware attacks.
  • It is recommended the client take out a form of cyber insurance to protect their website in the event the site is impacted and affected by malware, resulting in the loss of business.
  • All effort will be made to upkeep a clients website only if we are contracted to conduct monthly maintenance, this will involve regular malware checks, safety checks, updates and secondary backups in the event that any files are lost and the client experiences hosting issues.
  • If we are not contracted to run monthly maintenance checks, then that liability falls to the client not to us.

Website Creations and Redesigns
  • All work carried out for new websites and website redesigns is done to the best capabilities of the designer, according to the specifications outlined by the client.
  • Though all effort is made to accommodate the needs of each individual client, there may be times where some requirements on a site are not achievable.
  • However, we will endeavour to find alternatives to satisfy the client needs.
  • At times, work may be commissioned out to other contractors when required for work such as specialised coding and design.
  • For all website redesign work with new clients, a mandatory audit on a website for the fee of $200 needs to be carried out. This will produce a report for the client on what needs to happen with the redesign.
  • Upon acceptance of this audit from the client, work will be carried out.
  • As for new designs, unless specified by the client, we will source the right type of theme and layout for the business and upon approval of the chosen design, work will commence on that agreement.

SEO Audit:
  • SEO work is organically created for all websites. This means no paid features are used to enhance the SEO capabilities of a site.
  • Organic use of keywords, meta data, and tag relevant to the brand of the business are used in accordance with the standard guidelines of SEO strategies and implantation to help boost traction of a website online and create better brand awareness.
  • Though all effort is made to boost SEO for a website, using organic methods of optimisation for a site which is free, can take some time to see results.
  • These such results are not due to the work carried out by us, but rather a natural progression of naturally boosting a site for better optimisation online competing with other businesses in the same field.
  • This means, competition with other businesses who have paid for front page internet search results will always take priority over businesses who have not paid to be on the front page of a search.
  • We are not liable for such results.

Content Creation and Writing Services:
  • Client must in detail, specify exactly what they require with respect to content on a website design or redesign.
  • This means all content in its raw form must be provided to us, to ensure the right information for a client’s brand is relevant and appropriate for publication on all websites.
  • We are not responsible for the information that is published to a site, when the business of a client is not ours.
  • Content Creation covers full editorial and creative aspects of all content provided by the client, to ensure it is SEO compatible with online searches, uses the right terminology for branding online, and is grammar is correct.
  • If a client works in the space of health and beauty, Rebecca Wilkinson is a qualified journalist and freelance writer in those fields and can help produce the appropriate content for a client’s site, whether that be website content in general or for blog posts.

Social Media Content:
  • Any content created for clients by us is stock free and free of any copyright issues, unless specified in tags in the event content such as imagery or videos is re-shared from other related accounts for collaboration and exposure.
  • All content created is credited to the business and business owner, not to us.
  • In the event a client finds something posted inappropriate or not relevant to the business and branding, the client has the full right to contact us via text, phone or email and respectively ask us to change the image or remove the post.
  • No refund can be provided for content posted on social media. However, we will work with the client to resolve the issue as a matter of urgency to ensure the client is happy with the end result.
